KEEPUSAFE, and it’s domain names, are the trading name of Barclay Advanced Technology Group Limited. The website provides a service to you, or other users who have given their consent, allowing the automatic programming of a short cut key on your mobile phone(s) and those of other users. Your use of the web site and acceptance of the SIM update that performs the re-programming, is subject to these terms and conditions:-

Subscriptions

• You undertake that all details you provide to KEEPUSAFE.CO.UK for the purpose of subscription, ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own, or is being used with the explicit consent and authorisation of the card holder, and that there are sufficient funds to cover the cost of the product or service being ordered.
• If there are any changes to the details supplied by you it is your responsibility to inform KEEPUSAFE.CO.UK as soon as possible.
• All subscriptions are for a period of twelve months and are non-exchangeable, non-refundable and non-transferable without the explicit consent of KEEPUSAFE.CO.UK.
• If you make an error in the subscription process; (The web site may not necessarily stop you from subscribing to an erroneous make or model, of mobile phone or inputting the incorrect mobile phone number) you do so at your own risk.
• The acceptance of a SIM update and the act of subscription to KEEPUSAFE.CO.UK constitutes a legal contract between yourself and KEEPUSAFE.CO.UK, By making the Subscription and accepting the SIM update you undertake to honour the subscription terms which you make.
• Prices are in British pounds (£) and include VAT, or any other relevant sales tax, unless otherwise stated. VAT may be charged on the whole or partial amount of the subscription and is subject to the determination of HM Customs and Excise as to the liability and amount of VAT due as they may determine from time to time.
• KEEPUSAFE.CO.UK is entitled to refuse any request placed by you either on its website or via SMS whether placed directly or via a third party.
• KEEPUSAFE.CO.UK may pass on your credit card and any other essential subscription details to your credit card company or other trusted third parties. The placing of an order for any goods or services by you will constitute consent to KEEPUSAFE.CO.UK passing on such details.

Web site and SMS communication

• KEEPUSAFE.CO.UK endeavour to ensure that the information available on the web site at any one time is accurate. However KEEPUSAFE.CO.UK assumes no duty to update such information and cannot guarantee that it will be available 100% of the time, up to date, complete, accurate or fault-free.
• Customers are advised of and are responsible for reading the information sections.
• KEEPUSAFE.CO.UK will use its best endeavours to correct errors and omissions as quickly as practicable after being notified of them.
• The copyright in this web site, and any communications emanating from it, specifically but not limited to: email and SMS messages, belongs to the Barclay Advanced Technology Group. All other intellectual property rights are reserved. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer or sell any information obtained from this web site. You may only download to your personal computer for viewing purposes and print out a number of pages of this web site for your personal use.
• KEEPUSAFE.CO.UK uses the mobile phone infrastructure of mobile telephone companies to communicate using the SMS protocol. These third party services are subject to the local signal reception of a particular phone and also interruption to the service by the mobile telephone companies and KEEPUSAFE.CO.UK cannot be held responsible for those services in any way.
• By using KEEPUSAFE.CO.UK you may incur additional SMS charges from your mobile phone network. If KEEPUSAFE.CO.UK is charged for sending SMS messages by your network, then you agree to refund to KEEPUSAFE.CO.UK the costs of those SMS messages. Payment will be taken by KEEPUSAFE.CO.UK from the same source of funds as the subscription charges.
• When you choose to re-programme the shortcut key on your phone you do so at your own risk. It is your responsibility to ensure that the re-programming has been successful and that you are able to utilise the re-programmed features as intended.
• The over the air (OTA) SIM re-programming process contains proprietary information and code and remains the property of KEEPUSAFE.CO.UK. By accepting this agreement you agree not to: tamper, copy, or manipulate this code in any way, without the explicit approval in writing of KEEPUSAFE.CO.UK.

Liability

• KEEPUSAFE.CO.UK cannot be responsible for services offered by it through third parties or for any aspect of the relationship between you and that third party.
• KEEPUSAFE.CO.UK does not accept liability for any errors and omissions and reserves the right to change information, specifications and descriptions of specified subscriptions and services at anytime. KEEPUSAFE.CO.UK cannot accept responsibility for any misleading description.
• The web site is provided on an "as is" and "as available" basis. KEEPUSAFE.CO.UK makes no representation and excludes any warranty, express or implied, as to the availability, quality, timeliness, performance or fitness for a particular purpose of any of the products or services available at the KEEPUSAFE.CO.UK web site.
• You recognise the inherent security risks and that KEEPUSAFE.CO.UK shall have no responsibility or liability in respect of or arising out of any communications or network defect, delays, interruptions of failure whilst using the web site.

Governing Law

• English law shall govern every aspect of these terms and conditions and the parties agree to submit to the jurisdiction of the English courts in respect of any dispute arising under these terms and conditions.

• KEEPUSAFE.CO.UK will not reveal your e-mail address to third parties but it cannot guarantee that through the actions of a malicious third party these details do not become available.
• KEEPUSAFE.CO.UK makes no representation or warranty regarding the accuracy or reliability of any schedule, or any other information provided to you via this web site and you hereby release and waive any claims against KEEPUSAFE.CO.UK concerning the accuracy or reliability of such information.
• Unless expressly provided in these terms and conditions, no term is enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999 by any person who is not a party to it.

• KEEPUSAFE.CO.UK may changes these term and conditions at it’s absolute discretion and will post details of any changes to these terms and conditions on the web site.
